Governor Newsom Vetoes AI Regulation Bill, Citing Innovation Concerns

California Gov. Gavin Newsom vetoed a comprehensive AI bill that supporters argued would introduce necessary regulations for the rapidly advancing technology, while critics warned it would stifle innovation.

The proposed legislation, SB 1047, aimed to enforce safeguards such as testing requirements and kill switches for AI systems. It would also have granted the state attorney general the authority to sue companies if the technology was misused in catastrophic events like mass casualties or cyberattacks.

Explaining his veto, Newsom emphasized that the bill's focus on developer size, rather than actual risks posed by AI, was misplaced. "The key debate is whether regulation should be based on the computational power used to develop AI or on the system’s actual risks, irrespective of its scale," Newsom stated.

"While SB 1047 was well-intentioned, it fails to consider whether an AI system is being used in high-risk areas, in critical decision-making, or with sensitive data. Instead, the bill imposes stringent standards on even basic AI functions if they are deployed by large systems," he added.

During this legislative session, Newsom approved 17 other AI-related bills, addressing issues like deepfakes, AI watermarking, and misinformation around elections. He also announced a new initiative to collaborate with AI experts, including Fei-Fei Li, Tino Cuéllar, and Jennifer Tour Chayes, to create guidelines for the safe and responsible use of AI.

“We have an obligation to protect Californians from the potentially disastrous consequences of GenAI,” Newsom said. “We will work swiftly and thoughtfully to create adaptable solutions that safeguard the public while harnessing AI’s benefits.”

The veto came after significant speculation about Newsom's stance on the bill. Over 120 actors and producers, as well as AI pioneers Geoffrey Hinton, Yoshua Bengio, and Elon Musk, urged the governor to approve it. On the opposing side, companies like Google, Meta, and U.S. Rep. Nancy Pelosi argued the bill would hinder innovation by adding legal risks to AI development.

"To be clear, I agree we must not wait for a catastrophe to take action," Newsom said. "However, I believe we need a solution informed by an empirical understanding of AI systems and their capabilities. A regulatory framework must evolve with the technology to be truly effective."
